By accessing or using FixFirst ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FixFirst is an automated accessibility testing tool that scans websites for potential accessibility issues based on WCAG 2.1 AA guidelines. The Service provides:

  • Automated accessibility scans using industry-standard testing tools
  • Prioritized issue reporting based on enforcement likelihood
  • Monitoring and tracking of accessibility improvements over time
  • Fix suggestions and guidance for detected issues

3. Important Limitations and Disclaimers

3.1 Not Legal Advice

The Service does not provide legal advice. Nothing in the Service, including scan results, reports, scores, or recommendations, constitutes legal advice or a legal opinion. You should consult with a qualified attorney for legal guidance regarding accessibility compliance.

3.2 Not a Compliance Certification

The Service does not certify compliance with ADA, Section 508, WCAG, or any other accessibility standard or regulation. Scan results do not constitute a compliance determination, certification, or guarantee of accessibility.

3.3 Automated Testing Limitations

Automated testing detects approximately 30-40% of potential accessibility issues.The Service uses automated testing tools that cannot detect all accessibility barriers. Many accessibility issues require manual testing by qualified professionals. A clean scan does not mean your website has addressed all accessibility barriers.

3.4 No Guarantee of Legal Protection

Use of the Service does not protect you from legal action. The Service does not guarantee protection from lawsuits, complaints, or regulatory enforcement actions related to accessibility. Addressing issues identified by the Service does not eliminate legal risk.

4. User Responsibilities

You are responsible for:

  • Ensuring you have authorization to scan the websites you submit
  • Implementing fixes for accessibility issues identified by the Service
  • Conducting manual accessibility audits in addition to automated scans
  • Consulting with qualified accessibility professionals for comprehensive evaluation
  • Maintaining compliance with applicable laws and regulations

5. No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Accuracy, completeness, or reliability of scan results
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Legal fees, fines, or penalties related to accessibility lawsuits or complaints
  • Loss of business, revenue, or profits
  • Damage to reputation
  • Costs of procuring substitute services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Payment Terms

Paid plans are billed monthly or annually in advance. You authorize us to charge your payment method for all fees. Refunds are provided at our sole discretion. You may cancel your subscription at any time, effective at the end of the current billing period.

8. Acceptable Use

You agree not to:

  • Scan websites you do not own or have authorization to test
  • Use the Service to harm, harass, or violate the rights of others
  • Attempt to reverse engineer, decompile, or extract the source code
  • Abuse the free scan feature or circumvent rate limits
  • Resell or redistribute the Service without authorization

9. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our data practices.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify you of material changes via email or through the Service.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately.
